A transport company, to obtain a freight transport trade license or passenger transport trade license in the Czech Republic, must first go through registration. For the granting of a transport concession, the law requires a person referred to as a responsible representative for the road transport trade (sometimes also "responsible representative for transport" or "transport guarantee person"). The transport guarantor fulfils the legal conditions according to § 11 of the Trade Licensing Act and enables the company to obtain a license to operate freight or passenger transport. The responsible representative can be an employee of the company or cooperate with it on the basis of a contract. The responsible representative does not manage the company but guarantees in his name the fulfilment of legislative requirements so that the transport license is not denied.

Responsible representative road transport – why is it mandatory and how does it affect obtaining a transport license?

To operate transport in the Czech Republic, a license for freight transport or license for passenger transport is required. The responsible representative road transport helps with this. If the future company owner does not meet the qualification requirements according to the Trade Licensing Act, he is obliged to appoint a guarantor. Such business support helps to quickly enter the market and at the same time perform activities within the law. This representative does not influence the company's activities but only performs the function of submitting the necessary documents to avoid the risk of license refusal.

What are the requirements for the candidate

The candidate or responsible representative must meet certain requirements in order for the license to be correctly issued. The main legal requirements for a responsible representative include:

  • professional education in the field of transport or logistics (secondary or university) – not mandatory;
  • passed professional exam at the regional office – so-called certificate of professional competence in transport – mandatory;
  • experience in the field of road transport for hire or reward;
  • proven integrity and legal capacity;
  • knowledge of EU and Czech transport legislation.

The responsible representative does not manage the company, but his name is listed on the transport license as a guarantee of the company’s professional competence. The representative does not interfere with the day-to-day operations of the company and all responsibility lies solely with the owner.

This price includes professional guarantee, registration in the transport license, and fulfilment of all legal obligations under the Trade Licensing Act. The price is the same for both the freight transport trade and passenger transport trade, if it concerns vehicles up to 3.5 tons or up to 9 persons including the driver.

Mandatory carrier liability insurance

The amount of insurance is calculated based on the number of vehicles registered to the company. The more vehicles, the higher the insurance limit required by law.
